1. ABOUT THIS POLICY
1.1 Who We Are.
MiChargr Inc. (“MiChargr,” “we,” “our,” or “us”) is a Florida corporation that operates a network of portable power bank rental stations located in venues in the United States. We currently operate in Florida, Michigan, Georgia and the District of Columbia.
This Privacy Policy (“Policy”) explains what information we collect when you rent a power bank, how we use it, and the choices you have.
MiChargr is a rental service, not a data business. We collect the minimum information needed to rent you a battery, charge you for it, and get it back. We do not sell, rent, or share your personal information with anyone.
1.2 The MiChargr Service.
The “Service” means our power bank rental stations, the MiChargr mobile application, the rental web page you reach by scanning a QR code at a station, the tap-to-pay terminal on our stations, the digital advertising screens attached to our stations, our website at michargr.com, and our customer support channels.
1.3 Scope and Acceptance.
This Policy applies to anyone who rents a power bank from us, uses our website or mobile application, or contacts us. By using the Service, you acknowledge that you have read and understood this Policy. This Policy, together with our Terms of Service, forms the agreement between you and MiChargr. The current version is always posted at michargr.com and is identified by its Last Updated date.
1.4 United States Only.
MiChargr operates exclusively in the United States. We have no international offices, entities, subsidiaries, or operations, and the Service is neither directed to nor offered in other countries. We do not transfer personal information outside the United States.
2. INFORMATION WE COLLECT
We collect personal information — information that identifies, relates to, or could reasonably be linked with a particular individual or device — in two ways: information you choose to give us, and a limited set of information generated automatically when you rent.
You are not required to create an account to use MiChargr. Every rental is a one-time guest transaction.
2.1 Information You Provide.
(a) Contact information — optional. You may provide your name, email address, and/or phone number when starting a rental. Providing this is optional. If you rent using tap-to-pay at a station without providing contact details, we do not collect your name, email, or phone number at all.
(b) Payment information. All payment card information is collected and processed directly by Stripe, our payment processor. MiChargr never receives or stores your full card number, CVV, or equivalent payment credentials. We receive only a transaction confirmation and limited identifiers, such as the last four digits and card brand, needed to service the rental and handle disputes.
(c) Promotional and loyalty information. If you use a promo code or participate in our loyalty program, we record the code used and the rentals associated with your phone number or email address.
(d) Communications. The content of support requests, emails, and any survey responses you send us.
2.2 Information Collected Automatically.
(a) Rental and transaction data. The date and time a rental starts and ends, rental duration, the station the battery was taken from and returned to, the amount charged, and any promo code applied.
(b) Station identifier. Every rental is associated with the specific station used, which indicates the venue where the rental took place. We treat this as part of the transaction record — it is how we track our inventory and know where our batteries are. We do not collect GPS coordinates, precise device location, geofencing signals, beacon or proximity data, or any information about where you are outside of the station where you transacted.
(c) IP address. Our stations and rental application record the IP address of the device used to start a rental. We use this only for security, fraud prevention, and troubleshooting, and we retain it for a short period (see Section 6). We do not use IP addresses to determine your location for marketing, advertising, or profiling purposes.
(d) Device type. Basic technical information about the device or browser used to start a rental, so the rental page displays and functions correctly.
(e) Support records. Records of your correspondence with our support team.
2.3 Cookies and Similar Technologies.
The MiChargr rental flow uses only cookies and equivalent technologies that are strictly necessary to operate the Service — maintaining your session while a rental is being processed and securing the transaction. Our payment processor, Stripe, may set its own strictly necessary cookies to process payment and prevent fraud.
We do not use advertising cookies, third-party analytics tools, marketing pixels, social media trackers, or any cross-site tracking technology. We currently run no analytics platform of any kind.
You can manage cookies through your browser settings. Disabling strictly necessary cookies may prevent the rental flow from working.
2.4 Information We Do Not Collect, Sell, or Share.
The following is a commitment, not merely a description of current practice. If any of it changes, we will update this Policy and provide notice before the change takes effect, as described in Section 12.
MiChargr does not:
- Sell or rent your personal information to anyone, for any price;
- Share your personal information with third parties for cross-context behavioral advertising or targeted advertising;
- Collect GPS coordinates or precise device location, or use geofencing, beacons, or proximity technologies;
- Track you across other websites, applications, or services;
- Collect or infer demographic information, including age, gender, race, ethnicity, income, or household composition;
- Build behavioral profiles, audience segments, lookalike audiences, or modeled attributes about you;
- Participate in data clean rooms, data co-ops, identity resolution programs, or any other data collaboration arrangement;
- Upload contact information or device identifiers to advertising or marketing platforms;
- Use your personal information to train artificial intelligence or machine learning models;
- Store full payment card numbers or equivalent payment credentials;
- Collect government-issued identification numbers;
- Collect health, medical, or biometric information; or
- Operate cameras, microphones, or people-counting sensors on our stations.
2.5 Advertising on Our Screens.
MiChargr sells advertising time on the digital screens attached to our stations. This advertising is contextual and non-personalized.
Advertisements run on a fixed rotating loop and display identically to everyone in the vicinity. No advertisement is selected, targeted, or varied based on any individual’s personal information, rental history, or device. Our stations have no cameras or sensors and cannot detect who is nearby.
Advertisers receive proof-of-play verification confirming when and on which screens their campaign ran. Advertisers do not receive personal information, rental records, individual-level data, demographic information, or audience segments from us. We sell screen time, not audience data.
2.6 Categories of Personal Information (California Consumer Privacy Act).
The following table identifies the categories of personal information we have collected in the preceding twelve (12) months.

MiChargr has not sold or shared personal information in the preceding twelve (12) months, and has no plans to do so.
3. HOW WE USE YOUR INFORMATION
3.1 Providing and Operating the Service.
To process rentals and returns; to authorize and charge payment through Stripe; to track battery inventory and identify unreturned units; to charge the applicable fee if a power bank is not returned within 48 hours; to provide customer support; and to resolve billing disputes.
3.2 Service Communications.
To send you messages directly related to an active rental — including rental confirmations, return reminders, return confirmations, receipts, and fee notices. These are operational messages necessary to provide the Service, not marketing. See Section 5.2 regarding text messages.
3.3 Promotions and Loyalty.
To administer promo codes and our loyalty program, and to apply earned benefits to your rentals.
3.4 Marketing Communications.
Where you have opted in, to send you MiChargr promotions and service updates. Marketing is optional and separate from the Service, and you may opt out at any time (Section 9.1). We market only our own service. We do not market on behalf of third parties and do not use your information to target you on any third-party platform.
3.5 Aggregate Analysis and Service Improvement.
To understand how our stations are used in aggregate — utilization rates, rental duration patterns, peak times, and station performance — so that we can place, stock, and maintain equipment effectively. This analysis is performed on aggregated and de-identified data.
3.6 Venue Reporting.
To provide our venue partners with aggregated, de-identified performance reporting for their location. See Section 4.3.
3.7 Safety, Security, and Legal Compliance.
To prevent and investigate fraud, theft, and abuse of the Service; to enforce our Terms of Service; to establish or defend legal claims; and to comply with applicable law and legal process.
3.8 Legal Bases for Processing.
We process personal information to perform our contract with you (rental fulfillment and billing); on the basis of our legitimate interests in operating, securing, and improving the Service; with your consent where required by law, including for marketing text messages; and to comply with legal obligations.
4. HOW WE SHARE INFORMATION
4.1 We Do Not Sell or Share Your Personal Information.
MiChargr does not sell, rent, trade, or otherwise disclose personal information to third parties for their own purposes, including for advertising, marketing, or data monetization. We are not a data broker and we do not participate in any data marketplace, exchange, or collaboration program.
The disclosures described below are the complete and exclusive list of circumstances in which your information leaves our control.
4.2 Service Providers.
We use two vendors that may access personal information in the course of operating the Service:

Both vendors process information solely on our instructions and solely to provide services to us. They are contractually prohibited from using your information for their own purposes, from selling it, and from disclosing it to anyone else. Under California law these are “service providers,” and disclosures to them do not constitute a sale or share of personal information.
Stripe processes payment data as an independent controller for certain purposes, including fraud prevention and its own legal compliance. Stripe’s privacy practices are described at stripe.com/privacy.
4.3 Venue Partners.
Our stations are installed in venues operated by third parties. We provide those venue partners with aggregated and de-identified reporting on station usage at their location, such as total rentals and utilization rates. We do not provide venue partners with your name, contact information, payment information, IP address, or individual rental records.
4.4 Advertisers.
We provide advertisers with proof-of-play verification and campaign delivery reporting. We do not provide advertisers with personal information of any kind. See Section 2.5.
4.5 Legal and Safety Disclosures.
We may disclose information where required by law, subpoena, court order, or other legal process; to protect the rights, property, or safety of MiChargr, our users, or the public; to investigate fraud or theft of our equipment; or to enforce our agreements.
4.6 Corporate Transactions.
If MiChargr Inc. is involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction. Any acquirer will remain bound by the commitments in this Policy with respect to information collected under it, unless and until you are given notice and, where required by law, an opportunity to consent to a different policy. We will provide notice of any such transfer as required by law.
4.7 With Your Consent.
We may share information with others where you have specifically directed or consented to it.
5. CONSENT
5.1 How We Obtain Consent.
Where the law requires consent, we obtain it through a clear affirmative action — a checkbox, toggle, or equivalent — presented at the relevant point in the rental flow. Consent to marketing is entirely voluntary and separate from anything required to rent a power bank. Declining marketing does not affect your ability to use the Service, and we will not charge you a different price or provide a lesser service because you declined.
5.2 Text Messages.
If you provide your phone number, we send transactional text messages related to your active rental, including return reminders and return confirmations. These messages are part of the Service and are the reason we ask for your number. Standard message and data rates may apply.
We send promotional text messages only with your prior express written consent, obtained through a standalone opt-in separate from any other agreement, in compliance with the Telephone Consumer Protection Act (TCPA).
You may opt out of promotional messages at any time by replying STOP to any promotional message.
5.3 Withdrawing Consent.
You may withdraw consent at any time using the controls in Section 9 or by contacting us at info@michargr.com. Withdrawal does not affect the lawfulness of processing that already occurred.
6. DATA RETENTION
We keep personal information only as long as needed for the purposes described in this Policy, to meet legal and accounting obligations, and to resolve disputes. Because MiChargr does not offer user accounts, all retention periods run from your last rental rather than from account closure.

Where you rent using tap-to-pay without providing contact information, we hold no contact information about you at all, and the transaction record is retained solely for accounting purposes.
We apply data minimization principles and review our retention practices at least annually.
7. DATA SECURITY
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include:
- Encryption of data in transit;
- Storage on Amazon Web Services infrastructure, using its access control and security capabilities;
- Payment processing handled entirely by Stripe, a PCI-DSS Level 1 certified provider, so that full card data never enters MiChargr systems; and
- Internal access limits, so that personal information is accessible only to personnel who need it to operate the Service.

No system is perfectly secure and we cannot guarantee absolute security. If we become aware of a security breach affecting your personal information, we will notify you and applicable regulators as required by law, including under Florida Statutes § 501.171.
8. CHILDREN’S AND MINORS’ PRIVACY
The Service is not directed to children. We do not knowingly collect personal information from anyone under sixteen (16) years of age. If we learn that we have collected information from a child under 16, we will delete it promptly. If you believe a child has provided us with information, contact us at info@michargr.com.
MiChargr does not place stations in K-12 school environments.
We do not sell or share the personal information of any user, and we do not use the personal information of minors for targeted advertising or profiling under any circumstance.

9. YOUR CONTROLS AND CHOICES
These controls are available to everyone, regardless of where you live.
9.1 Marketing Communications.
You may opt out of marketing at any time by clicking the unsubscribe link in any marketing email or replying STOP to any promotional text message. You will continue to receive transactional messages about an active rental.
9.2 Sale and Sharing of Personal Information.
MiChargr does not sell or share personal information for targeted advertising, so there is nothing to opt out of. We honor the Global Privacy Control (GPC) browser signal as a matter of policy. If our practices ever change, we will provide an opt-out mechanism and notice before any such change takes effect.
9.3 Location.
We do not collect precise or GPS location. If our mobile application offers a feature that locates nearby stations, any device location permission it requests is optional, is used only to display nearby stations on your device, and can be revoked at any time in your device settings without affecting your ability to rent.

9.4 Access, Deletion, and Other Requests.

10. YOUR PRIVACY RIGHTS
Depending on your state of residence, you may have some or all of the rights below. MiChargr extends these rights to all users in all states, regardless of whether your state’s law requires it.
- Right to Know and Confirm. Confirm whether we process your personal information and learn about our processing practices.
- Right to Access. Request the specific pieces and categories of personal information we hold about you, its source, why we use it, and who we have disclosed it to.
- Right to Delete. Request deletion of your personal information, subject to exceptions permitted by law — for example, we may need to retain transaction records for tax purposes, records of your text message consent, or information needed to complete a rental or resolve a dispute.
- Right to Correct. Request correction of inaccurate personal information we hold about you.
- Right to Data Portability. Receive a copy of the information you provided in a portable, readily usable format.
- Right to Opt Out of Sale or Sharing. We do not sell or share personal information. See Section 9.2.
- Right to Opt Out of Profiling. We do not profile users and do not make automated decisions that produce legal or similarly significant effects.
- Right to Limit Use of Sensitive Personal Information. We do not collect sensitive personal information as defined by applicable law.
- Right to Non-Discrimination. We will not deny service, charge a different price, or provide a different quality of service because you exercised a privacy right.
- Right to Appeal. If we deny a request, you may appeal by emailing info@michargr.com with the subject line “Privacy Rights Appeal.” We will respond within the timeframe required by your state’s law.
A note on identifying you. Because MiChargr does not require accounts, we can only locate your information if you provided an email address or phone number at the time of rental. If you rented using tap-to-pay without providing contact information, we hold no information that identifies you, and we will not be able to associate a request with a particular individual. We will not collect additional information from you solely to attempt to identify you.
11. THIRD-PARTY LINKS AND INTEGRATIONS
MiChargr’s website and rental application do not embed or integrate third-party advertising services, social media widgets, analytics tools, or tracking technologies. Where we link to an external website, that site’s own privacy policy governs your interaction with it, and we are not responsible for its practices.

12. CHANGES TO THIS POLICY
We may update this Policy as our service evolves. When we do, we will post the revised Policy at michargr.com and update the Last Updated date above.
For material changes — including any change to what we collect, how we use it, or whether we disclose it to third parties — we will provide advance notice through the rental application, our website, or by email or text to the contact information associated with your recent rentals, and we will obtain your affirmative consent where the law requires it.
We will not begin selling or sharing personal information, collecting precise location data, or collecting demographic data without notifying you first.
For non-material changes, continued use of the Service after the Last Updated date constitutes acceptance. If you do not agree with a revised Policy, you should stop using the Service.
We review this Policy at least annually.
13. CONTACT US AND SUBMITTING A REQUEST
To exercise any right described in this Policy, or to ask a question about it, email info@michargr.com.
Please include enough information for us to locate your records — the email address or phone number you used when renting — and tell us which state’s law you are relying on. Please do not include payment card numbers, government identification numbers, or other sensitive credentials in your request.
We will verify your identity before acting on any request and will respond within the timeframe required by applicable law, generally thirty (30) to forty-five (45) days from receipt, with an extension available on notice where permitted by law.
If you are submitting a request on behalf of someone else as an authorized agent, we will need written permission signed by that individual, verification of your own identity, and direct confirmation from that individual that you are authorized to act on their behalf.
